Court Policy

COURT POLICY REGARDING SEARCH OF RECORDS  Top

All record searches on-site are to be conducted at the department which handles that particular casee type. South Lake Tahoe Superior Court is the only court that handles all case types. Please address your request to:

Requests at the Counter

The customer will be directed to look through the court index for case numbers and/or case names filed prior to 2000. If the customer is looking for a case number and/or case name filed 2000 or later, the clerk will search the computer index. Requests that involve more than 3 names will need to be provided in written form to the court and left for processing. There will be no charge for this service. All written requests will be conducted on a first come/first serve basis and will be completed within 10 business days. If the customer requests the “clerk” conduct a search of case numbers and/or case names filed prior to 2000, the customer must put the request in writing and provide the appropriate search fee. These requests will also be conducted on a first come/first serve basis and will be completed within 10 business days.

Telephone or Fax Requests

Case number and/or name searches or record searches will not be conducted by telephone. The customer will be given the opportunity to come to the courthouse to look through the court index where there will be no charge or send their request by mail with payment and self-addressed stamped envelope.

Search of records filed after the year 2000 may be submitted by fax if the customer requires only a case number result. Results of searches submitted by fax may be picked up at the Clerk’s Office, may be emailed to the requestor or returned by mail in a self-addressed, stamped envelope. Requests that are received at the incorrect branch will be stamped with the date received and routed to the correct department where they will be processed in date order.

Mail Request

If submitting search by mail, enclose a check made out to Superior Court on the payee line, and on the payment line write “amount not to exceed $35.00” or the amount given to you by the clerk for your transaction.

If the customer is requesting copies of documents, such as sentencing information, judgment paperwork, pleadings, etc., the customer must provide the case name and/or case number. The search fee of $15.00 will apply and there will be an additional charge of $0.50 per page for copies of documents. If the case is in storage, there will be a $4.00 retrieval fee for each file requested.

Search Results

The Court will provide only the case number identified from a name search unless the customer specifically requests additional information and provides the appropriate payment for searching and copying of documents.

Processing of Search Requests

To insure accurate results for searches, the customer should include as much detail as possible. Requests should include case name, date of birth, case number, date of filing, etc. Processing of search requests will be completed within 10 business days.

Search Fees

Record Search $15.00 (for each search of records or files that requires more than 10 minutes)

Copies of documents $0.50 (per page)

Certified copy $15.00 (per document plus copy fee)

Retrieval Fee $4.00 (per case)


COURT POLICY REGARDING PHOTOCOPYING CASE FILES  Top

Requests for photocopying of entire case file or more than five (5) documents in a case file
The Court requires five (5) business days to complete requests for photocopying. The fee for copying is $0.50 per page. The customer submits their request for photocopying either by mail or at the counter with an installment payment, check not to exceed $20.00. If the fee for photocopying exceeds $20.00, the customer will be required to pay the additional fee before the copies are delivered. If the copied documents are to be returned to the customer by mail, a self-addressed envelope with postage prepaid is required.


COURT POLICY REGARDING SERVICE OF PROCESS  Top

If the El Dorado County Superior Court, a judge and/or staff person in his or her official capacity is a named party to an action or proceeding involving a tort claim or for production of records, service shall be effected on the Court Executive Officer as agent for service of process at 2850 Fairlane Court, Placerville, California.

Court mediators or other staff may be subpoenaed to attend a civil action or proceeding as a witness in litigation in a matter regarding an event or transaction which he or she perceived or investigated in the course of his or her duties, to which the court and/or employee is not a party. Service of the subpoena may be by delivering a copy either to the person personally or to the Court Executive Officer as the agent designated to receive service.

The amount of one hundred fifty dollars ($150) shall be tendered for each day that an employee is required to remain in attendance pursuant to a subpoena. (Pursuant to Government Code Section 68096.1 & 68097)
