Petition for Order Appointing Successor Trustee; Distribution
Petitioner Victor Fancher is the surviving spouse of Virginia Fancher, who was
trustee of the trust prior to her death. The trust is for the benefit of the
three children, all of whom are adults, and all of whom nominate Victor Fancher
as successor trustee. Distribution was supposed to have been made when the three
children reached their majority.
While living, Virginia mistakenly transferred certain real property into a different
trust, the Fancher Family Trust. Victor acknowledges that the transfer was in
error and will transfer the property to the Cecilia Papini Testamentary Trust.
The trust assets will then be distributed under the terms of the trust to the
three children.
TENTATIVE RULING # 2: WITHOUT OBJECTION, THE PETITION IS GRANTED AS PRAYED.
